1) Is the Americans with Disabilities Act a federal building code?

Technically, the Americans with Disabilities Act is not a building code. It is a civil law with requirements that prohibit discrimination in the usage of buildings. Very simply, the law states that any new construction or altered / remodeled facility must be made accessible to all persons (including the physically disabled) according to the ADA guidelines.
